Campaign Freedom of Access to Information 2008

 

Group of non-governmental organizations started initiative for amending the Law on Free Access to Information of Public Importance. By suggested amendments is planned, among other things, introducing protection for “whistle blowers”– persons which point out to irregularities and corruption in their organizations and institutions, punishing of responsible persons instead of authorized, as well as specifying certain regulations which have been randomly interpreted in the past three years.

Capacity-Building in Public Procurement in Serbia

 

Corruption in the area of public contracting wastes enormous amounts of public money which is urgently needed for the most basic public services. This is in large part due to the fact that the procurement of public goods and services amounts to 16 % of the overall Gross Domestic Product (estimations for Serbia ). It is these large amounts of money which create strong temptations and which offer ample opportunities for corruption in the public sector. In Serbia , the amount of public procurement is even greater than in other countries due to huge number of non-privatised enterprises. At the same time, potential risks of corruption is greater due to strong influence of political parties to the work of public enterprises and deeply rooted practices and mechanisms of illicit public contracting. On global level, that damage from corruption is estimated at normally between 10 and 25% of the contract value, while no firm data of that kind exists for Serbia

This project, which Transparency Serbia implements in cooperation with Center for Development of Non-profit Sector from Belgrade and group of local nongovernmental organizations, examines matter of financing of nongovernmental organizations from budget of Serbia, and determines what is considered as budget classification "481- donations to nongovernmental organization" by which project got its title.

Bidders Advice Support

 

Bidders advice support is one of the most important supports to regularity of public procurements. System of protection of rights in Serbia is regulated by Public Procurement Law and is designed as two-stage. It means that, in first stage, bidder complaints to procurement entity, then if procurement entity denies its demand, bidder files complaint to Commission for Protection of Bidders Rights, as a second stage organ which can decide to annul procedure totally or partially or to dismiss bidder's complaint. Commission's decision is final and no complaint nor administrative dispute can be brought against it.

Besides many already existing reasons to fight corruption, Serbia got a new one – possibility of establishing regime without visas with European Union countries. Considering news from Brussels, to accomplish this goal, against which are not even the biggest Euro- skeptics, it is necessary, among other things to implement regulations on criminals' property confiscation, implementing anticorruption regulations and establish independent agency for fight against corruption, adopt ethical codes and to conduct training for servants which give away passports or work in customs, fulfill GRECO recommendations (which Serbia adopted in mid 2006) and to implement anticorruption convention of UN and Council of Europe which Serbia ratified. .» more  »

Evaluation of GRECO experts (Group of States against corruption, which functions under favour of Council of Europe) is one of the most significant instruments for monitoring progress that countries made in fight against corruption. By entering GRECO in 2003, former Serbia and Montenegro accepted the obligation to follow recommendations. It is good to note that GRECO evaluates only some segments, not entire legal and institutional framework for fight against corruption. In cooperation with Westminster Foundation for Democracy from London, Transparency-Serbia is conducting analysis of printed media writing about corruption in Serbia. Website Energy observer , on March 20 this year, published text which analyzes advantages and imperfections of public tenders in reference to direct negotiations. The intention of the text is to, in principal level, point why direct negotiations sometimes seems to have advantages over more complex procedures which secure larger transparency and explains why is using of public tenders more compatible to democratic systems. Transparency Serbia considers that it is extremely important for implementation of the Law on Free Access to Information that competent Parliamentary Committee unanimously adopted the Commissioner's report about work and implementation of the Law in 2005. In previous implementation of Law particularly arguable were regulations of supervision over implementation, that are connected to authority over bringing the misdemeanor charges against liable persons in public bodies that denied the right to free access to information. Ministry of Culture, which currently does that function, unfortunately, since the adoption of the Law didn't form a special service that would do this kind of supervising, so, by the available information, they submitted zero demand for bringing the misdemeanor charges in more than 200 cases of legal offence Commissioner submitted to Ministry. » details »

As part of the program “Cooperation with civil sector”, The EU Integration Office Government of Serbia and organization Transparency Serbia, on November 9 th , signed the memorandum on the cooperation in the process of European integration.Having in mind previous role of NGOs in development of democratic, civil society in Serbia and their contribution in spreading European ideas and values, as well as the necessity of regular and objective informing of citizens about process of accessing the EU, signing of this memorandum should contribute through mutual exchange of information, organization of public debates about draft of laws and other regulations concerning the process of access and harmonization of activities and projects.

European Commission in its latest progress report of Serbia and Montenegro stabilization and association process, again treats corruption as one of most serious problems of our country. President of Transparency Serbia at the meeting with director of World Bank. During his brief visit to Belgrade, the World bank Director, Mr. Paul Wolfowitz, had a meeting with representatives of several civil society organization, including Dr. Vladimir Goati, Transparency Serbia's president. At the meeting were discussed topics related to the transition process in Serbia in the past five years including the corruption risks of the process, as well as key challenges that Serbia is going to face with in this process in the future.
